Heritage building disability access Performance Solutions in NSW
Heritage fabric often blocks a Deemed-to-Satisfy ramp, handrail, door or sanitary layout. That is a trigger for a documented Performance Solution. It is not a waiver from equitable access under the NCC or the Premises Standards.
Current NSW work is assessed against NCC 2022 Amendment 2 until NSW adopts NCC 2025 on 1 May 2027. The Premises Standards, as amended, reference AS 1428.1:2021 from 29 July 2025. The general pathway sits on our disability access Performance Solutions page. This page is the heritage product for architects, heritage consultants and Principal Certifiers on alterations and additions.
Heritage is a trigger, not a waiver
Heritage listing does not create an exemption. For residual shortfalls after a Performance Solution, see unjustifiable hardship under the Premises Standards.
Cost, convenience or “it looks wrong on the streetscape” do not, by themselves, justify a departure. The Performance Requirements for access still apply. Heritage significance explains why the DtS geometry cannot be followed without unacceptable fabric loss. The Performance Solution then has to show how the same Performance Requirements are still met, with conditions and limitations the PCA can independently certify.
Existing buildings also sit under the Premises Standards “affected part” framing when new work is proposed. Map the affected part early. Do not treat a listing or a Conservation Management Plan extract as an exemption letter.
Typical heritage access departures
Ramps that cannot achieve DtS gradient or landings
A DtS ramp on a significant porch, stair or shopfront often means cutting fabric or projecting into a public footpath. The brief must name the fabric that would be lost, the gradient and landing that can be built, and the comparison with DtS.
Door clear openings on constrained historic openings
Stone, timber or metal frames that cannot accept an 850 mm clear opening without destroying the opening need measured drawings and a method that still allows independent use where the Performance Requirement demands it.
Sanitary circulation that cannot be documented as DtS
Retrofit sanitary rooms in heritage cores regularly fail circulation, grabrail or door-swing geometry. Stretching an AS 1428.1 layout on paper is not a solution. Status the room honestly, then brief a Performance Solution or a different room.
Single-sided handrails
A second rail may be blocked by significant joinery or an adjoining tenancy. The brief should record why the second rail cannot be fixed and how users are still supported on the circulation path.
TGSI and luminance contrast on irregular paving
Significant stone or tessellated floors often cannot take a standard TGSI field. Photograph the paving, measure contrast, and agree the assessment method with the PCA before you lock the finish schedule.
NCC process the certifier expects
Governing Requirement A2G2 is a four-step process in plain language:
- Prepare a performance-based design brief (PBDB) that names the departure, the Performance Requirements, and the proposed Assessment Methods.
- Circulate the draft brief to the PCA and other agreed stakeholders for comment on the approach.
- Analyse the design against the agreed methods.
- Issue the Performance Solution report with conditions, limitations and the evidence pack.
Older search language still says “Alternative Solution” or “Section D3.” Alternative Solution is the former name. Access DtS now live primarily under Part D4 of NCC Volume One.
Evidence that usually survives review
| Heritage trigger | What the PBDB must name | Evidence that usually carries |
|---|---|---|
| Ramp or landing that would cut fabric | Exact DtS clause, fabric significance, proposed geometry | Measured sections, photos, comparison with DtS, construction method |
| Historic door leaf or frame | Clear opening available vs DtS, user group, swing and hardware | Frame survey, hardware data, evidence of suitability |
| Sanitary room in a significant core | Which circulation or fixture fails DtS | 1:50 plan with turning spaces dimensioned, product sheets |
| Single-sided handrail | Why the second rail cannot be fixed | Photos of the blocking fabric or tenancy, proposed rail detail |
| TGSI on significant paving | Wayfinding risk and proposed substitute cue | Contrast readings, paving photos, agreed method with PCA |
Comparison with DtS, measured drawings and product evidence of suitability are the methods that usually survive PCA review. Expert judgement used alone on Premises Standards-related access departures attracts extra scrutiny. Combine methods where you can.
Independence from the PCA
The Principal Certifier must independently assess compliance. Preparing the solution they will certify creates a conflict risk. Sydney Access Consultants prepares the brief and report. The PCA comments on whether the approach is acceptable to certify. Do not ask the certifier to write their own access Performance Solution.
How this sits beside the DA or CC access report
An access report for DA, CC or CDC verifies DtS and flags departures. The Performance Solution documents the pathway for those departures. Design documentation support while the set is moving sits on access-led documentation support. Edition confusion (2022 Amendment 2 versus NCC 2025 headlines) is explained in NCC 2025 adoption in NSW.
What to send
- Drawing package that isolates the non-compliant element
- Any prior access mark-up or RFI
- Consent conditions that mention access or heritage
- PCA contact so the draft PBDB can be circulated
- Heritage significance notes or CMP extracts where they exist
- Site photographs of the fabric and the proposed path of travel
Work for Cronulla, Sutherland Shire and Hurstville / Georges River is the day-to-day catchment. Mid North Coast heritage and adaptive-reuse jobs can be supported with Sandy Grey at Black Beach. Perth jobs use the applicable WA NCC edition, not the NSW deferred date.
Answer-ready questions
Is a heritage access Performance Solution an exemption from disability access?
No. It is another documented way of meeting the same NCC access Performance Requirements. Heritage significance explains why DtS cannot be followed. It does not remove equitable access obligations.
When should we engage an access consultant on a heritage job?
As soon as a DtS departure is identified on the planning or construction set, before the certificate date is booked. Late briefs stall CC and CDC.
Can our certifier write the Performance Solution?
The Principal Certifier must independently assess compliance. Engage an independent access consultant and keep the PCA in the brief loop for comment on the approach.
