Childcare access reports in NSW: what DA and CC need for early learning centres

Childcare and early learning proposals in NSW commonly need a disability access report as development application supporting information, and again at construction certificate when the certifier must be satisfied the detailed design meets NCC access provisions. There is no single statewide clause that forces a report on every project. Practice follows the DCP, the council checklist, consent conditions, and Premises Standards triggers. Lodgement language for all building types is on disability access reports for DA and CC.

Short answer

Commission the access review while the plan is still flexible. The items that most often force a late redraw, and that can cost teachable floor area, are accessible parking and drop-off, a break in the continuous accessible path, door clearances and circulation, and the accessible sanitary compartment for people who work in or visit the centre. Children's sanitary design follows operational and education-and-care rules as well as building rules. Do not invent an exemption. Verify the Premises Standards and NCC notes for the class before you omit an accessible facility.

NSW lodgements remain on NCC 2022 Amendment 2 until 1 May 2027. The Premises Standards reference AS 1428.1:2021 from 29 July 2025. Edition timing is on NCC 2025 in NSW.

When councils and certifiers ask for the report

At development application, councils often ask for an access report where the proposal is a childcare centre, early learning centre or education and care service, or where the DCP or checklist names access. The report tests whether the design is capable of meeting access requirements: path of travel, entries, parking, sanitary facilities, and any vertical circulation.

At construction certificate or complying development certificate, the certifier needs elemental status against the Premises Standards, the NCC access provisions consistent with consent, and AS 1428.1:2021. A development application report that says "capable" is not the construction certificate report. Status words are set out on what certifiers want in an access report.

Design items that blow up late

Send plans before the development application with this list marked. Each item should be compliant, capable subject to detail, non-compliant, or insufficient information.

Childcare reports and school reports are different products

Both are commonly Class 9b education or care settings under the Premises Standards, with access to and within areas normally used by the occupants. A school report, including a demountable classroom package, trades on campus paths, halls and affected parts. A childcare report trades on drop-off, outdoor play, and the split between staff and visitor sanitary provision and children's sanitary design. Do not recycle a school template. Disability Standards for Education 2005 obligations sit with the education provider. They are not a substitute for Premises Standards compliance on the building. School reports are on school and education access reports.

DA capability and CC verification

At development application, "capable of compliance" means the plan can meet the access provisions once dimensions are fixed, without relying on a non-compliant leftover space. At construction certificate, the certifier expects door widths, circulation, sanitary set-out, parking and path gradients dimensioned, with a status on each. Complying development combines the planning and construction tests. Late sanitary redesign after rooms are locked is how child places get squeezed. Review the plan while partitions can still move.

Performance Solutions in constrained centres

Do not import a warehouse exemption into an early learning centre. NCC D4D5 can be discussed for a plant room, case by case, but play rooms and staff areas normally used by occupants are not exempt because a factory template says so. Warehouse and factory exemptions are on D4D5 exemptions for industrial buildings.

Adaptive reuse, steep sites and heritage shells often cannot deliver deemed-to-satisfy ramp, landing or sanitary geometry without losing the service. A Performance Solution is the honest path when deemed-to-satisfy cannot be met. Heritage fabric is covered on heritage access Performance Solutions. Do not stretch a non-compliant ramp and call it deemed-to-satisfy.

Pipeline note

Sydney's social-infrastructure pipeline remains active. The NSW Planning Portal records SSD-77240466, a residential care facility at 36-42 Cabbage Tree Road, Bayview, determined on 22 September 2026. That is an aged-care state significant development, not a childcare project, and Sydney Access Consultants does not claim involvement. It is cited only to show that education, care and seniors clients are lodging now.

How Sydney Access Consultants helps

Sydney Access Consultants prepares plan assessments and DA, CC and CDC access reports for childcare and early learning centres, with the aim of catching path and sanitary geometry before child places are locked. The Hurstville office covers Cronulla, the Sutherland Shire and Georges River. Sandy Grey is based at Black Beach for Mid North Coast centres. Frequently asked questions

Do NSW childcare centres need a disability access report?

Often yes in practice. There is no single clause that requires every NSW project to lodge an access consultant's report, but childcare proposals commonly need one as development application supporting information and again at construction certificate. Check the DCP, council checklist and consent conditions.

What usually forces expensive late redesign?

Accessible parking and drop-off, breaks in the continuous accessible path, insufficient door clearances or circulation, and accessible sanitary provision for staff and visitors. Fixing those after rooms are locked can cost teachable floor area.

How is a childcare access report different from a school access report?

Both sit in the Class 9b family under the Premises Standards, but childcare plans trade differently around outdoor play, drop-off and operational sanitary design. Use a childcare brief. Keep Disability Standards for Education obligations separate from building compliance.

What should the report say at DA versus CC?

At DA, capability: the design can meet access requirements once detailed. At CC, elemental status with dimensions. Do not reuse the DA report unchanged.

When is a Performance Solution appropriate?

When existing fabric, a steep site or a heritage shell cannot meet deemed-to-satisfy geometry. Document the performance requirement and the evidence. Do not promise an outcome before the assessment.

How do you engage Sydney Access Consultants without compromising teachable area?

Send sketch plans before development application, with the checklist above. Early path and sanitary decisions protect floor area. Call (02) 9586 3111.
