DSAPT now in force (13 October 2026): amended Transport Standards, Guidelines, and Premises/NCC misalignment

The amended Disability Standards for Accessible Public Transport 2002 came into effect on 13 October 2026, together with the Disability Standards for Accessible Public Transport Guidelines 2026. The Guidelines interpret the Standards; they are not the enforceable Standards themselves. On 15 October 2026 the Australian Building Codes Board noted that the amended Transport Standards no longer fully align with the Premises Standards and the National Construction Code. On a facility that mixes premises and transport infrastructure, identify which instrument applies to each part, case by case. Last updated 27 October 2026.

Confirmed: commenced 13 October 2026

The Infrastructure reform page and the ABCB note of 15 October 2026 both state that the Transport Standards and supporting guidelines were amended and took effect on 13 October 2026. The amending instrument F2026L01002 shows as no longer in force after that date because the amendment has been incorporated. A full compilation of the Standards as amended was expected on the Federal Register of Legislation in the coming weeks after commencement; check legislation.gov.au for the current principal compilation. The reforms emphasise staff training, easier journey-planning information, and improved safety and design specifications across the public transport journey. Schedule 1 compliance dates in the 2002 Standards were not extended.

Premises Standards and NCC no longer fully line up

The ABCB noted on 15 October 2026 that previously the Transport Standards, Premises Standards and NCC were generally aligned. The recent amendments introduce some differences. A transport facility can still comply with all applicable requirements because the Transport Standards and Premises Standards generally apply to different parts of a facility. The Transport Standards include exceptions where the Premises Standards apply. Where a facility contains both premises and transport infrastructure, identify which requirements apply to each part and assess the delineation case by case. Premises Standards may be reviewed in future for further alignment; any future Premises amendments may flow into future NCC editions.

Which rules apply to my project? (Part 35 in plain English)

After commencement on 13 October 2026:

Always confirm against the instrument or compilation in force on the decision day. The Guidelines supply timing clues; cite the Standards text for mandatory application.

What else changed for operators and design teams

Part 31A emphasises training covering disability awareness and rights, journey barriers, use and upkeep of accessible features, and DDA obligations including assistance animals. Co-design or co-facilitation is preferred, with routine refreshers. Equivalent access under Part 33 themes is available where unassisted access has unavoidable constraints or an alternative gives greater access; it is not a loophole for segregated parallel services. Direct assistance sits alongside physical access, not instead of it. Point to the Infrastructure operator summary and information kit for section-level detail rather than treating this page as a clause-by-clause rewrite.

Frequently asked questions

Have the amended Transport Standards commenced?
Yes. The Disability Standards for Accessible Public Transport 2002 were amended on 13 October 2026, and the Disability Standards for Accessible Public Transport Guidelines 2026 were updated at the same time. The Guidelines help interpret the Standards; they are not themselves the enforceable Standards. Check legislation.gov.au for the current compilation and the Infrastructure reform page for operator resources.

Do the Transport Standards still line up with the Premises Standards and the NCC?
Not fully. The Australian Building Codes Board noted on 15 October 2026 that the recent amendments introduce some differences between the Transport Standards and the accessibility requirements that apply to public buildings through the Premises Standards and the NCC. A transport facility can still comply with all applicable requirements because the instruments generally apply to different parts of the facility. Where a facility mixes premises and transport infrastructure, identify which requirements apply to each part and assess the delineation case by case.

Which version of the Standards applies to my project?
It depends on project stage at commencement. Projects still in planning generally use the amended Standards. Projects already approved or under construction at 13 October 2026 generally stay on the non-amended Standards for that project. Existing assets continue under the non-amended Standards unless Part 35 provides otherwise. Substantial refurbishment picks up the amended requirements for the works being done. Confirm against the instrument in force on the decision day.
